Privacy Policy

This policy explains what information DiscoveryMark collects, how we use it, who we share it with, and the choices you have.

DiscoveryMark LLC ("DiscoveryMark," "we," "us," or "our") operates the website at discoverymark.com and the DiscoveryMark property operations dashboard (together, the "Service"). DiscoveryMark is based in Charleston, South Carolina. This Privacy Policy describes how we handle information in connection with the Service.

By using the Service, you agree to this Privacy Policy. If you do not agree, please do not use the Service.

Two kinds of information, two different roles.

DiscoveryMark is a tool that landlords and property managers use to document their own properties and tenants. That means two distinct relationships:

  • Account information. For information about you, our account holder (your email, name, and how you use the Service), DiscoveryMark decides why and how it is processed. We are responsible for it as described in this policy.
  • Customer Data. For information you enter or upload about your properties, tenants, vendors, and other third parties, you decide what is collected and why. You are responsible for that information, and DiscoveryMark processes it on your behalf to provide the Service. If you are a tenant or other individual whose information was entered by a DiscoveryMark customer, please direct privacy requests to that customer (the landlord or property manager), since they control that data. We will support our customers in responding to those requests.

1. Information we collect

Information you provide directly

  • Account and profile information. When you sign up, we collect your email address. DiscoveryMark uses passwordless sign-in, so we email you a one-time code to verify your identity rather than storing a password you create. When you complete your profile we also collect your name and, optionally, your company or workspace name. We store your role within a workspace (for example, owner, admin, or member).
  • Team and invitation information. If you invite teammates, we collect the email addresses you provide and the role you assign them.
  • Support and communications. If you contact us for support, sales, or other reasons, we keep the messages you send and our responses.

Customer Data you submit through the Service

As you use the Service, you and the people you invite can enter or upload information into workflows and records, including:

  • Property information, such as addresses, property type, and status.
  • Tenant and contact information, such as names, email addresses, phone numbers, and status.
  • Workflow and form responses submitted during Move-In, Move-Out, Maintenance, Lease Violation, and other workflows.
  • Files, documents, and photos you or your tenants upload. You control what you upload, and these files may contain sensitive information depending on how you use the Service.
  • Electronic signatures along with the signer's name, timestamp, and IP address captured at the time of signing.
  • Notes and internal comments you add to properties, tenants, and records.

You are responsible for the information you put into the Service and for having the rights and any consents needed to do so. See our Terms and Conditions for more on your responsibilities.

Payment information

Payments and subscriptions are processed by our payment provider, Paddle. Paddle acts as the merchant of record and collects and processes your payment details directly. DiscoveryMark does not receive or store your full card number. We receive limited billing information from Paddle, such as your card type, the last four digits of your card, billing status, and the customer and subscription identifiers we use to manage your plan. Paddle's handling of your information is governed by its own privacy policy.

Information collected automatically

  • Usage and log data, such as the pages and features you use, actions you take, and timestamps.
  • Device and connection data, such as IP address, browser type, and device information.
  • Cookies and similar technologies used to keep you signed in, remember preferences, and measure usage, as described below.

2. Cookies and analytics

We use cookies and local storage to operate the Service, keep you signed in, and remember your preferences. We also use Google Analytics 4 to understand how the Service is used so we can improve it. Google Analytics collects information such as your IP address, the pages you view, and events you trigger.

You can opt out of our analytics tracking at any time. The Service respects a do-not-track preference: setting the "dm-dnt" flag in your browser (or enabling your browser's Do Not Track setting) tells us not to load analytics. You can also block or delete cookies through your browser settings, though some parts of the Service may not function properly without them.

3. How we use information

We use the information described above to:

  • Provide, operate, and maintain the Service, including authenticating you and generating records and PDFs;
  • Send you transactional messages, such as one-time sign-in codes, workflow notifications, and account or billing updates;
  • Process payments, manage subscriptions, and prevent fraud;
  • Provide customer support and respond to your requests;
  • Monitor, secure, troubleshoot, and improve the Service;
  • Send you product news or marketing where permitted, which you can opt out of; and
  • Comply with our legal obligations and enforce our agreements.

We process Customer Data only to provide and support the Service, in accordance with your instructions and our Terms and Conditions.

4. How we share information

We do not sell your personal information. We share information only in the following ways:

  • Service providers and subprocessors. We use trusted third parties to run the Service. These include Amazon Web Services (cloud hosting, authentication, and file storage), Paddle (payment and subscription processing), and Google (analytics). These providers may process information on our behalf and are bound by obligations to protect it.
  • At your direction. When you launch a workflow or send a record, we share the relevant information with the recipients you choose, such as your tenants or teammates.
  • Legal and safety. We may disclose information if required by law, subpoena, or legal process, or where we believe disclosure is necessary to protect the rights, safety, or property of DiscoveryMark, our users, or others.
  • Business transfers. If DiscoveryMark is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction, subject to this Privacy Policy.

5. Data retention

We keep account information and Customer Data for as long as your account is active and as needed to provide the Service. When you close your account, or when a workspace owner asks us to delete data, we will delete or return Customer Data within a reasonable period, except where we are required or permitted to retain it to comply with legal obligations, resolve disputes, prevent fraud, or enforce our agreements. Residual copies may remain in routine backups for a limited time before they are overwritten.

6. How we protect information

We use technical and organizational safeguards designed to protect information, including encryption of data in transit, access controls, and passwordless authentication that avoids reusable passwords. Payment card data is handled by Paddle under its own security and PCI compliance program. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. You are responsible for keeping access to your email account secure, since it is used to sign in.

7. Where information is stored

The Service is operated in the United States, and information is stored and processed on infrastructure located in the United States. If you access the Service from outside the United States, you understand that your information will be transferred to and processed in the United States, where data protection laws may differ from those in your location.

8. Your choices and rights

  • Access and update. You can review and update your account and profile information by signing in to the Service.
  • Deletion. You can ask us to delete your account and associated personal information by emailing austin@discoverymark.com. If you are a tenant or other individual whose information was entered by a DiscoveryMark customer, please contact that customer, who controls the data.
  • Marketing. You can opt out of marketing emails by following the unsubscribe link in those messages. We will still send transactional messages needed to operate your account.
  • Analytics. You can opt out of analytics as described in the Cookies and analytics section above.

Depending on where you live, you may have additional rights regarding your personal information, such as the right to access, correct, or delete it, or to object to certain processing. To exercise any rights you may have, contact us at austin@discoverymark.com and we will respond as required by applicable law. We will not discriminate against you for exercising these rights.

9. Children's privacy

The Service is intended for business use by adults and is not directed to children. We do not knowingly collect personal information from anyone under 18 years of age. If you believe a child has provided us with personal information, please contact us and we will take appropriate steps to delete it.

10. Third-party links and services

The Service may contain links to third-party websites or services that we do not operate. This Privacy Policy does not apply to those third parties, and we are not responsible for their content or privacy practices. We encourage you to review the privacy policies of any third party you interact with.

11. Changes to this policy

We may update this Privacy Policy from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised policy.
